Large data quantities and big Data applications are gaining commercial relevance. Substantion investments are made into data gathering in order to improve, for example, targeted advertising. In this context the question to whom the data belong becomes more and more relevant.

There is no alternative to a clear contractual agreement on the use rights for data.

In a judgemet of 7 May 20215 the Higher Administrative court in Hessia ruled for the first time on the question when TV show are to be deemed “submissible” in the meaning of the State Treaty on the Protection of Minors. At the same time, this is a judgement on the basic principles of the relation between public supervision and the institution of voluntary self-control in questions regarding the protection of minors.
